Allgemeine Geschäftsbedingungen (AGB) für Fine-Art-Prints und Gutscheine
Stand: Oktober 2026 · Version 1.1

Terms and Conditions for Fine-Art Prints and Gift Vouchers · Last updated: October 2026 · Version 1.1
This is a courtesy translation. Only the German version above is legally binding.
Lovely to have you here. These terms explain how buying my limited prints and gift vouchers works: clearly, fairly, and with no small print that takes anything away from you. Your statutory rights as a consumer always remain in place.
1. Seller and scope
1.1 The seller is Jyrwynn Mendoza, trading as “Wynn Florante”, sole trader, Office Center Stadtpark 1, Top M1.13.06, Landstraßer Hauptstraße 2, 1030 Vienna, Austria, phone +43 664 217 06 19, email contact@wynnflorante.co, VAT ID ATU76926123 (“I”, “me”). All further details are in the Impressum (legal notice).
1.2 These terms apply to all contracts for the purchase of fine-art prints and of gift vouchers that you conclude with me through my online shop at www.wynnflorante.co, and to the redemption of these vouchers (section 17).
1.3 My offer is open to consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) as well as to businesses. Provisions that apply only to consumers are marked as such. Mandatory consumer protection law always takes precedence over these terms.
1.4 Buyers’ own terms apply only if I expressly agree to them.
1.5 These terms do not cover framing that you request from me separately, deliveries outside the delivery area that we agree by email at your request (you receive a separate offer with all the information), purchases made directly at my studio or at events, or photo and video commissions. This also applies to sessions paid for in full or in part with a gift voucher: the session itself is governed by the terms we agree when you book; the voucher and its redemption are governed by section 17.
2. Prints and product descriptions
2.1 I sell limited, hand-signed and numbered fine-art prints of my own photographs on Hahnemühle fine-art paper, each with a certificate of authenticity signed by me. The prints are sold unframed and shipped rolled in a tube. Each product page lists the main features of the print, in particular title, format, paper, edition size, price and delivery terms.
2.2 How colours and contrast look on your screen depends on your device and its settings. The product description states the paper and format of the print. Your statutory guarantee rights are not affected.
2.3 You receive the next available edition number of the motif, unless the product page says otherwise.
3. Ordering and conclusion of the contract
3.1 How to order a print (how to buy a gift voucher is explained in 17.3):
- On the product page, choose the format (if more than one is offered) and add the print to your cart.
- In the cart, check your selection, change quantities or remove prints, then go to checkout.
- Enter your email address and choose shipping or free pickup at the studio. For shipping, enter the delivery address.
- Enter your card details or, if you have a gift voucher, its code (see 17.6). Instead of entering your card details, you can also use Apple Pay, Google Pay or Link (see below). The card payment is processed by the payment provider Stripe.
- Before you submit, you see a summary of the prints you are ordering and their main features, the total price including VAT and shipping, and links to these terms, the withdrawal information and the privacy policy.
- By clicking the final order button, you place a binding order with an obligation to pay.
Apple Pay, Google Pay and Link: If they are shown to you (see 5.1), you can choose Apple Pay, Google Pay or Link at the top of the checkout instead of paying by card. With Apple Pay and Google Pay, you check the delivery address, shipping or pickup option and total in the payment window and confirm the payment, depending on your device for example with Face ID, fingerprint, passcode or a double click. With Link, a Stripe service, you sign in with a confirmation code that Stripe sends you; Stripe then fills in the details you saved there. If no final order button appears afterwards, your confirmation of the payment already places a binding order with an obligation to pay; if it still appears, the order is placed only when you click it.
3.2 Correcting input errors: until you click the order button, you can change any entry directly in its field, adjust your selection in the cart, or cancel by closing the window. With Apple Pay, Google Pay and Link, you can change your details, such as address and card, as long as you have not confirmed the payment. If you cancel there or close the payment window, nothing is ordered.
3.3 Conclusion of the contract: by submitting your order you make a binding offer. I accept it by automatically sending you the order confirmation by email immediately afterwards. This concludes the contract of sale.
3.4 At the latest on delivery or pickup, you receive a confirmation of the contract with all legally required information on a durable medium: by email and also as a printed insert in the parcel or at pickup.
3.5 Contract text: I store your order data; the details of your order are in the order confirmation. You can view, save and print these terms at any time at www.wynnflorante.co/agb. On request, I will send you the version that applied when you ordered.
3.6 The contract language is German.
4. Prices and shipping costs
4.1 All prices are final prices in euros. Print prices include statutory VAT; no VAT is charged when you buy a gift voucher (see 17.5).
4.2 For prints, shipping costs are added. They depend on the delivery area and the total weight of your order, are listed on the Shipping & Returns page and are shown at checkout before you submit your order. Pickup at the studio is free of charge.
5. Payment
5.1 You pay by credit or debit card. Instead of entering your card details, you can also use your card through Apple Pay, Google Pay or Link; the card you choose there is then charged. Apple Pay and Google Pay appear at checkout only if your device and browser support them. Link is a Stripe service where you can save your card details for future purchases; whether you do so is up to you. Card payments, including those through Apple Pay, Google Pay and Link, are processed by the payment provider Stripe. You can also pay for prints in full or in part with a gift voucher (see 17.6). I do not offer any other payment methods. I do not charge an extra fee for any payment method.
5.2 The purchase price including shipping is due when the contract is concluded and is charged when you order or deducted from your gift voucher.
5.3 You receive your invoice by email.
6. Delivery and pickup
6.1 I deliver to Austria and to all other member states of the European Union. Excluded are territories that belong to an EU member state but lie outside the EU VAT area, in particular the Canary Islands, Ceuta and Melilla, the French overseas departments (Guadeloupe, French Guiana, Martinique, Mayotte and Réunion), Livigno, Büsingen am Hochrhein, Heligoland, Mount Athos and the Åland Islands. Deliveries to countries outside the EU are possible only on request by email, not through the checkout.
6.2 You can order wherever you live, as long as the delivery address is in the delivery area or you collect the print at the studio. If you nevertheless enter a delivery address outside the delivery area at checkout, I will contact you. You can then give a delivery address within the delivery area, collect the print at the studio, or withdraw from the contract; in that case I refund all payments without delay.
6.3 Delivery time: I dispatch your print within 3 working days after your payment. It reaches you no later than 8 working days (Austria) or 12 working days (other EU member states) after your payment. Because the price is charged when you order, these periods run from the moment your order is completed. Working days are Monday to Friday, excluding Austrian public holidays.
6.4 Pickup at the studio: if you choose pickup at checkout, your print is ready no later than 3 working days after your order. I will email you and we arrange a time at my studio (address above). If pickup does not work out as planned, I will get in touch and we will find a solution together, such as a new appointment or, if you wish, shipping at the rates on the Shipping & Returns page.
6.5 If, exceptionally, I am unable to deliver a print you ordered, I will tell you without delay and refund any payment already made without delay. This does not reserve me any right to withdraw from the contract; your statutory rights are not affected.
6.6 If I fail to deliver when due, you can set me a reasonable additional period and withdraw from the contract once it has passed (§ 7c KSchG). Your other statutory rights are not affected.
7. Passing of risk and ownership
7.1 For consumers: the risk of loss or damage passes to you only when the print is delivered to you or to a person you have named who is not the carrier. For pickup, the risk passes on handover at the studio. If you instruct a carrier yourself without using a shipping option I offer, the risk passes when the print is handed to that carrier (§ 7b KSchG).
7.2 The print remains my property until it has been paid for in full.
8. Right of withdrawal
8.1 As a consumer, you can withdraw from contracts you conclude through my online shop within 14 days without giving any reason (right of withdrawal under § 11 FAGG). For prints, the period starts on the day you, or a person you have named who is not the carrier, take possession of the print, so for pickup on the day of pickup; for gift vouchers, it starts on the day of purchase (see 17.11). If several prints from one order are delivered separately, it starts on the day you receive the last one. All details are in the withdrawal information. There you will also find the model withdrawal form, which you may use but do not have to.
8.2 The easiest way is online, using the “Vertrag widerrufen” (withdraw from contract) link at the bottom of every page or directly at www.wynnflorante.co/vertrag-widerrufen. I confirm receipt by email without delay, including the content of your statement and the date and time it was received. You can also withdraw by email or letter.
8.3 You bear the direct cost of returning the print. I estimate it per print at a maximum of approximately EUR 45 (110 × 172 cm) or EUR 25 (70 × 90 cm) when returned from Austria, and at a maximum of approximately EUR 90 (110 × 172 cm) or EUR 60 (70 × 90 cm) when returned from another EU member state. If you hand the print back in person at my studio by appointment, there is no return cost for you.
8.4 The right of withdrawal also applies to signed and numbered prints from limited editions. A returned print goes back into the edition under its original number.
8.5 If you paid for a print in full or in part with a gift voucher and withdraw from that purchase, I credit the amount paid with the voucher back to the voucher, i.e. the same means of payment; I refund any remaining amount to the card you paid with, including if you used it through Apple Pay, Google Pay or Link.
9. Legal guarantee and complaints
9.1 For consumers, the statutory legal guarantee under the Austrian Consumer Warranty Act (VGG) and the Civil Code (ABGB) applies. I am liable for defects that exist at handover and become apparent within two years. If a defect appears within one year of handover, it is presumed to have existed at handover. Your rights become time-barred three months after the guarantee period ends. For purchases by businesses, the guarantee rules of the ABGB and the Austrian Commercial Code (UGB) apply.
9.2 You can first ask for repair or replacement, and in certain cases a price reduction or termination of the contract. Before I provide a remedy, I will tell you about your right to choose between repair and replacement and about the possible extension of the guarantee period: if a defect is remedied by repair, the guarantee period is extended once by one year.
9.3 Replacement within the edition: a replacement print carries the same edition number as the defective print. I take the defective print back at my cost and destroy it. The edition size does not change.
9.4 If a print arrives damaged, please let me know as soon as you can and send a few photos of the print and packaging. This helps me claim with the carrier. Your statutory rights do not depend on it.
9.5 I do not give any additional commercial guarantee; the certificate of authenticity is not a guarantee in this sense. The EU harmonised notice on the legal guarantee is shown in the shop, through the “Gesetzliche Gewährleistung” (legal guarantee) link at the bottom of every page, and in your order confirmation.
9.6 Please send complaints to contact@wynnflorante.co or call +43 664 217 06 19. I usually reply within 5 working days.
10. Limited editions
10.1 Each motif is published in a limited edition of no more than 20 prints across all formats combined. The edition size and the formats offered are on the product page. Once set, an edition is never increased.
10.2 Artist’s proofs (“AP”) exist only if they are listed on the product page. They are marked “AP” and count towards the maximum of 20 prints per motif.
10.3 I sign and number every print by hand. It comes with a certificate of authenticity signed by me, stating the title, edition number, edition size, format and paper.
10.4 Once an edition has sold out, I do not reprint the motif: not as a fine-art print or any other edition print for sale, in no format, on no paper and in no other crop. The only exception is a replacement print under 9.3, which carries the number of the defective print and replaces it.
10.5 I reserve the right to show the motif in ways that are not prints for sale, such as in books, catalogues and press coverage, on my website and social media, and as exhibition prints that are not sold and are destroyed after the exhibition.
10.6 I keep an edition register (motif, format, number, date of sale, buyer) so that the provenance of every print can be shown. More in the privacy policy.
11. Copyright
11.1 With your purchase, you acquire ownership of the physical print. Copyright and all rights of use in the photograph remain with me.
11.2 You may display the print, give it away and resell it; please pass the certificate of authenticity on with it.
11.3 Except as permitted in 11.4, the following is not allowed without my consent: reproducing, scanning or photographing the print in order to distribute the copies; editing images of it, making them available online or otherwise to the public, or using them commercially (for example for advertising or merchandise); creating digital copies or tokens of it; using it to train AI systems. Uses permitted by law are not affected.
11.4 A photo of your print on your wall for your private social media makes me happy, ideally with the credit “© Wynn Florante” or @wynnflorante. If you want to resell the print, you may photograph it for that purpose and show the photos in your sales listing, for example on a marketplace or at an auction house.
12. Liability
I am liable in accordance with the statutory provisions.
13. Data protection
How I process your data for orders and gift vouchers, including the data of voucher recipients, is explained in the privacy policy.
14. Dispute resolution
If something is not right, please write to me first; we can usually find a solution quickly. I do not take part in dispute resolution proceedings before a consumer arbitration body. If we cannot resolve a dispute together, I will inform you on a durable medium, as required by law, about the competent arbitration body.
15. Applicable law and jurisdiction
15.1 Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you keep the protection of that country’s mandatory provisions (Art 6(2) Rome I Regulation).
15.2 Claims against consumers whose domicile, habitual residence or place of employment is in Austria may only be brought before the court for that place (§ 14 KSchG). Otherwise, the statutory places of jurisdiction apply.
16. Final provisions
16.1 Your order is governed by the version of these terms that was available when you ordered.
16.2 If any provision is invalid, the rest of the contract remains valid.
17. Gift vouchers
17.1 My gift vouchers are value vouchers for the euro amount you choose when you buy them. Each voucher has its own code. You can redeem it:
- for fine-art prints and all other products in my online shop (see 17.6), and
- for portrait and headshot sessions with me, by appointment (see 17.7).
17.2 The voucher is credited at the prices that apply when you redeem it. It has no expiry date: you can redeem it until your claim becomes time-barred 30 years after purchase (§ 1478 ABGB, Austrian Civil Code).
17.3 How to buy a voucher: on the voucher page, choose the amount; the purchase button takes you straight to checkout. There you choose whether the voucher is emailed to the person you are giving it to (you then enter their name and email address, your name and, if you like, a short message) or to yourself, so you can print it, forward it or hand it over in person. Then you enter your email address, billing details and card details, check the summary and make a binding purchase by clicking the final order button. If Apple Pay, Google Pay or Link is shown to you, you can pay with it instead; 3.1 explains when your purchase then becomes binding. A voucher is ordered on its own, not together with prints or other vouchers. For correcting input errors, conclusion of the contract, contract text, contract language and payment, 3.2, 3.3, 3.5, 3.6 and 5 apply. Your order confirmation email is also the confirmation of the contract, with all legally required information.
17.4 The voucher arrives automatically by email with its code right after purchase, sent to the recipient or to you, as you chose. A later sending date cannot be selected at checkout: if the voucher should arrive on a particular day, have it sent to yourself and forward it then. I do not post printed voucher cards, but you can print the email yourself.
17.5 The price of the voucher equals its amount. There are no shipping costs. No VAT is charged when you buy a voucher (multi-purpose voucher); VAT is included in the prices of the prints and sessions the voucher is redeemed for. Whoever redeems the voucher receives the invoice for them.
17.6 In the online shop, enter the code at checkout. The amount is deducted from your order total including shipping, and you see the remaining balance. If the balance is not enough, pay the rest by card (where shown, also through Apple Pay, Google Pay or Link) or with another voucher.
17.7 For a portrait or headshot session, email me at contact@wynnflorante.co with your code and what you would like. I confirm your balance and send you an offer with the service, price and date, the terms for the session and the information on your right of withdrawal for that contract. Once you accept, the contract for the session is concluded; it is governed by the terms in the offer, not by these terms (see 1.5). I deduct the price from your voucher only on the day of the session, up to the available balance. You then receive an email confirmation showing the remaining balance, and the invoice. If the price is higher than the balance on that day, you pay the rest as agreed in the offer.
17.8 Because I charge the voucher only on the day of the session, your balance stays unchanged if a session is cancelled or moved before then. If I have to cancel a session, I will suggest a new date; if you don't want one, your balance remains and you can use it in other ways. If you cancel, the terms agreed at booking apply.
17.9 You can redeem the voucher in several steps; any remaining balance stays on the code. The voucher or a remaining balance is not paid out in cash, except after a withdrawal (see 17.11) or if I no longer offer either prints or sessions: in that case I refund the remaining balance in money.
17.10 The voucher is not tied to a person: you can give it away or pass it on, and whoever has the code can redeem it. If I redeem the voucher for someone who gives me the code, it counts as used to that extent, unless I know that this person is not entitled to it or overlook this through gross negligence. So please keep the code safe. If the email gets lost, I am happy to resend it to the address given at purchase. If the code of a voucher that has not yet been used has fallen into the wrong hands, please tell me straight away: at the request of the person who bought the voucher, I will cancel it and refund the purchase price to them.
17.11 As a consumer, you can withdraw from the purchase of a voucher within 14 days without giving any reason (§ 11 FAGG). The period starts on the day the contract is concluded, i.e. the day of your purchase. The right of withdrawal belongs to the person who bought the voucher. You withdraw as described in 8.2, most easily online via “Vertrag widerrufen” (withdraw from contract). You don't need to send anything back. I cancel the voucher and refund the purchase price without undue delay and no later than 14 days after receiving your withdrawal, using the same means of payment and without fees; once cancelled, the code is no longer valid. All details are in the withdrawal information for gift vouchers.
17.12 Whatever is bought with the voucher, such as a print, is a separate contract with its own right of withdrawal (see 8). If that purchase is withdrawn from, I credit the amount paid with the voucher back to the voucher (see 8.5). If you withdraw from the voucher purchase after the voucher has already been used in full or in part, I will contact you and we will work out together how both contracts are unwound. Your statutory rights are not affected.
17.13 To deliver a voucher to someone you are giving it to, I need their name and email address. I use them only for the voucher, never for advertising. More in the privacy policy.
